Having regard to the Covid-19 pandemic, the oral rounds cannot take place at National Law University Odisha, Cuttack.

WHEREAS

  1. Pursuant to the power vested with the organising committee under Rule 15.6 of the Competition Rules and notwithstanding anything contained in the rules, this Addendum will apply to all participating teams during the virtual oral rounds of the competition.

  2. That the heads specifically not addressed by this Addendum will be governed by the Competition Rules mutatis mutandis.

  3. That the interpretation placed on the Addendum to the rules by the organising committee shall be conclusive and binding on all participating teams.

1. TEAM COMPOSITION

  1. A team shall consist of a minimum of two members and a maximum of three members. The participating teams may express their interest to change their registered team size by showing sufficient cause to the organising committee. However, the change shall be subject to the approval of the organising committee. ​

  2. Only those participants, duly registered as speakers in the registration form, shall be allowed to present the oral arguments. The participating teams may express their interest to change their speaker roles by showing sufficient cause to the organising committee. However, the change shall be subject to the approval of the organising committee.

  3. No changes in the team composition shall be allowed after the stipulated deadline.

  4. The order of speakers, i.e., Speaker 1, and Speaker 2, shall remain the same for the entire duration of the competition.

  5. All alterations or modifications to the team composition may be done by duly intimating the organising committee at imam@nluo.ac.in by 18th July 2020 (11:59 P.M. IST). The organising committee, at its sole discretion, reserves the right to disallow the requested alteration or modification if insufficient reasons are provided.

 

2. DRESS CODE​

The Dress Code for the virtual oral rounds shall be formals or semi-formals.

3. ​PROCEDURE AND GUIDELINES FOR THE VIRTUAL ORAL ROUND​S

Procedure and guidelines for the virtual oral rounds shall be sent to the participating teams shortly. They will apply to all participating teams during the virtual oral rounds of the competition in addition to this Addendum.​

4. UNFAIR MEANS

  1. The meeting link to the respective courtrooms shall not be shared by the team members with any party, not registered with the organising committee as a member of the team. In the event, any team is found to have shared their courtroom link; they shall face immediate disqualification from the competition.

  2. The use of any electronic device other than the device being used for virtual oral rounds is strictly prohibited during the oral rounds. In the event, a team is found in possession of the same, appropriate penalty ranging from deduction of round points to disqualification from the competition shall be imposed at the discretion of the organising committee, in consultation with the Arbitrators of the respective courtrooms.

  3. No audio or videotaping of the oral rounds is permitted, either via the platform or through third party screen recording apps, for the duration of the competition. Further, the teams are not permitted to take images or screenshots of their courtroom screen during the duration of the competition. The teams shall be provided photographs of their rounds by the organising committee after the completion of the competition. Contravention of this rule shall entail disqualification of the team.

  4. If the Arbitrators are of the opinion that the team is indulging in any unfair practice or inappropriate conduct, the organising committee reserves the right to award appropriate penalty ranging from deduction of round points to disqualification from the competition depending on the individual circumstance.

 

5. COMPENDIUM​

  1. The teams may submit their compendiums (if any) to the organising committee latest by 18th August 2020. For the removal of doubts, it is hereby clarified that submission of the compendium is not mandatory and the round points secured by the team will not be contingent on the submission of any such document.

  2. The compendium should be devoid of any identification marks which could compromise the anonymity of the Team, apart from the assigned team code.

  3. The compendium shall be provided to the Arbitrators by the organising committee before the respective oral rounds. It shall contain a Table of Contents page with all the relevant authorities hyperlinked to the appropriate page number for the convenience of the Arbitrators while it is being referred to by the Team during the virtual oral rounds.

  4. All reference materials should be compiled into the compendium on .pdf format. The Team can submit no more than one PDF file (for each side- Claimant and Respondent). Submissions received by the organising committee after the stipulated deadline shall not be permitted for usage during the virtual oral rounds.

  5. Screensharing or any other alternative mode of presentation by the teams shall not be allowed. Attempts to share screen or engaging in other attempts to present material to the judges during the virtual oral rounds will attract appropriate penalty, including but not limited to, deduction of round points.

 

6. SCORING CRITERIA​

  1. The assessment criteria as per Rule 11.3 of the Competition Rules shall be followed for the virtual oral rounds. ​

  2. Notwithstanding Rule 11.3 of the Competition Rules, the following procedure shall be adopted in case of technical glitches or other unprecedented contingencies-

    1. On account of the participating Team (s)​

      1. The round will be rescheduled to a later time/date.​

      2. If the problem persists even during the rescheduled round, the Team which has successfully joined the virtual courtroom will make ex-parte submissions.

      3. If a team fails to appear in rescheduled rounds from both sides, the team will be disqualified from the virtual oral rounds.

    2. On account of the Arbitrator(s)​

      1. If one Arbitrator is unable to join the virtual courtroom, the round shall continue with only two arbitrators judging the round.

      2.  If more than one Arbitrator is unable to join the virtual courtroom; the round shall be rescheduled to a later date/time.​

      3. All rounds will be judged by a minimum of two Arbitrators.

    3. Scoring Criteria​

      1. In the case of ex-parte rounds, the round points of the Team presenting the oral round will directly be determined by the Arbitrators. The round points of the Team that fails to present the oral round will be determined based on the round points secured by the Team in the other oral round. For the removal of doubts, it is hereby clarified that the three rounds points allocated to the memorial scores shall be considered based on the scheduled round irrespective of the Team’s failure to present the oral round.

      2. If the round is only judged by two Arbitrators, the average of the scores of the two Arbitrators will be considered as the third score.

8. AWARDS

The winner of the Final Round will be declared the “Winning Team”, while the losing finalist will be declared the “Runners-Up”.  The Team with the highest total memorial score will be awarded the “Best Memorial” award. The “Best Oralist” award shall be determined based on the cumulative points secured by a speaker in the Preliminary Rounds. To be eligible for the “Best Oralist Award”, a speaker must have argued in both the Preliminary Rounds.

  • The Winning Team (Best Team Award) shall be awarded INR 75,000 as prize money plus 3 Offline Internship slots at Bose & Mitra & Co. (as and when the situation normalises).

  • The Runners-Up Team (Second Best Team Award) shall be awarded INR 45,000 as prize money plus 3 Offline Internship slots at Bose & Mitra & Co. (as and when the situation normalises).

  • Best Oralist shall be awarded INR 15,000 as prize money.

  • Best Memorial shall be awarded INR 15,000 as prize money.

 

9. MISCELLANEOUS

  1. If any difficulty arises in giving effect to these rules, the organising committee may by e-mail communication make and amend such provisions, as it may appear to be necessary.

  2. TMS reserves the right to alter, vary, modify, or repeal these rules, without any prior notification, as it may deem fit.
